Special counsel Jack Smith is appealing the dismissal of the classified documents case against Donald Trump by urging an appeals court to reinstate the case. The case was dismissed by Judge Aileen Cannon last month, and it is now being appealed to the 11th US Circuit Court of Appeals. The appeal argues that Cannon’s decision was at odds with standard appointment practices in the Department of Justice. If the appeals court overturns the dismissal, there will not be a trial before the November presidential election. Trump could then appoint an attorney general who would dismiss the case if elected.
