Illinois immigrants are eligible for standard driver’s licenses


Illinois is set to implement a new law allowing non-U.S. citizen motorists to obtain standard driver’s licenses in an effort to promote equality and fairness while also ensuring safer roads. This law, signed by Governor J.B. Pritzker, brings the state in line with other progressive states like California, New York, New Jersey, and Oregon. The change in policy comes after years of advocacy by immigrant rights groups seeking improved access to essential services for noncitizens. Noncitizens previously only had access to Temporary Visitor Driver’s Licenses (TVDLs), which had limited use and did not grant access to important tasks like signing leases or picking up prescriptions.

In addition to the driver’s license law, Illinois is also implementing an annual state gas tax hike tied to inflation, bringing the tax to 47 cents per gallon. The revenue generated from this tax increase will go towards funding the Governor’s $45 billion Rebuild Illinois construction program. Secretary of State Alexi Giannoulias, who supports the new law, emphasized the importance of ensuring that all motorists on the road are licensed and knowledgeable about safety rules. A Stanford University study showed that similar laws in California had no negative impact on road safety.

The new law requires applicants to follow the same process as for a TVDL, including providing proof of residency, insurance, and identity. The law also includes privacy protections, prohibiting the use of driver’s license data for immigration enforcement and requiring immigration agents to have a court-issued warrant to request personally identifying information. These measures aim to eliminate discrimination and ensure that noncitizen immigrant drivers cannot obtain a REAL ID or be added to Illinois’ voting rolls.
